THULANI GAME LODGE & ECO ESTATE

WEATHER, BUSHVELD FIRE & FORCE MAJEURE DISCLAIMER

Terms & Conditions – All Current and Future Bookings

1. General Disclaimer

Thulani Game Lodge & Eco Estate (“TGL”) is situated in the Waterberg region of Limpopo Province, South Africa. Due to its natural bushveld surroundings, the lodge may be affected by seasonal weather conditions and environmental events beyond its reasonable control.

These may include, but are not limited to, severe storms, heavy rainfall, strong winds, thunderstorms, lightning strikes, flooding, bushveld fires, veld fires, smoke, drought-related fire risks, road damage, washaways and other natural events that may affect the lodge, its surroundings, accessibility, facilities or services.

Such events may occur unexpectedly and may affect guests currently staying at the lodge, as well as guests with upcoming or future bookings.

2. Summer Season – Severe Weather and Storms

During the summer rainfall season, the Waterberg region may experience heavy rainfall, strong winds, severe thunderstorms, lightning strikes, flooding and other adverse weather conditions.

These conditions may result in disruptions to lodge operations and guest services, including but not limited to:

Electricity and water supply interruptions.

Damage to buildings, infrastructure, equipment or other property.

Restricted or unsafe access roads, flooding and road washaways.

Temporary unavailability of facilities, amenities or services.

Delays, inconvenience or disruptions before, during or after a storm.

TGL will take reasonable steps, where practicable, to address disruptions and protect the safety of guests and staff. However, uninterrupted access, facilities and services cannot be guaranteed during severe weather events.

3. Winter Season – Bushveld Fires and Fire-Related Risks

During the winter months, dry vegetation, strong winds and other environmental conditions may increase the risk of bushveld fires in the Waterberg region.

Bushveld fires, veld fires, smoke, fire-related damage, road closures, restricted access, evacuation requirements and interruptions to electricity, water or other services may affect the lodge's operations and guests' current or future bookings.

Where bushveld fires or related conditions pose a risk to guests, employees, property or surrounding areas, TGL may restrict access to, suspend operations at, or temporarily close part or all of the lodge.

Such action may be necessary to protect lives and property, comply with emergency instructions, assess damage or carry out repairs.

4. Circumstances Beyond the Lodge's Reasonable Control

TGL cannot reasonably control or prevent all severe weather events, bushveld fires or their resulting consequences. The lodge shall not be held liable for losses, damage, inconvenience or interruptions arising from circumstances beyond its reasonable control, to the extent permitted by applicable South African law.

This disclaimer includes disruptions occurring before, during or after a storm, fire or other qualifying event. However, it does not exclude liability where such exclusion is prohibited by law or where liability arises from circumstances for which TGL is legally responsible.

5. Bookings, Rescheduling and Refunds

This policy applies to all current and future bookings, subject to applicable law and the terms governing each booking.

Where severe weather, bushveld fires, related damage or other circumstances beyond TGL's reasonable control materially affect a scheduled stay, TGL may, at its discretion and subject to availability, offer to reschedule the booking to an alternative date.

Rescheduling is not guaranteed and will depend on the circumstances, operational requirements and available accommodation. Any alternative arrangement must be confirmed directly with TGL.

TGL does not guarantee refunds or compensation solely because of adverse weather, bushveld fires, travel difficulties, inconvenience or temporary interruptions to facilities or services beyond its reasonable control.

All cancellation, refund and rescheduling requests will be handled in accordance with the applicable booking terms and South African law. Nothing in this disclaimer is intended to remove or restrict any statutory consumer right or legal obligation that cannot lawfully be excluded.

6. Temporary Closure and Safety Measures

TGL reserves the right to restrict access to, suspend operations at, or temporarily close any part or all of the lodge when severe weather, bushveld fires, infrastructure damage or other related circumstances make continued operations unsafe or impractical.

Where reasonably practicable, affected guests will be notified of material operational changes and advised of any available alternative arrangements.

The safety of guests, employees and other persons on the property will remain an important consideration when making operational decisions during severe weather or fire-related emergencies.

7. Guest Acknowledgement

By making or confirming a booking with Thulani Game Lodge & Eco Estate, guests acknowledge that the lodge is situated in a natural bushveld environment that may experience seasonal storms, heavy rainfall, flooding, bushveld fires and other environmental risks.

Guests are encouraged to monitor relevant weather and travel advisories, follow safety instructions and contact the lodge directly if adverse conditions may affect their planned visit.

This disclaimer forms part of the Terms & Conditions applicable to all current and future bookings, subject to applicable South African law.

We thank you for your understanding and cooperation and look forward to welcoming you to Thulani Game Lodge & Eco Estate.
